Octroi d’un échéancier de remboursement de la dette locative modulé dans le temps

TJ de Paris, ordonnance du 7 mai 2022, n° 12/21- 003324

M.K., locataire du parc social, est assigné en raison d’une dette locative. Le juge constate que les condi- tions d’acquisition de la clause résolutoire sont réunies et le condamne à verser à son bailleur une provision de 8 800 euros environ. Il accorde au locataire un échéancier de remboursement de sa dette locative, en modulant dans le temps les montants (mensualités de 5 euros du 1er au 12e mois, puis mensualités de 50 euros du 13e au 35e mois et le solde à la dernière échéance). Cela doit permettre d’éviter de mettre en difficulté le locataire, le temps qu’un dispositif de traitement de la dette locative puisse être sollicité.
