Des locataires assignent leur bailleur social en remboursement d’un supplément de loyer payé depuis 10 ans et en annulation du commandement de payer un arriéré locatif.
La Cour rappelle que l’article L442-12 du CCH3 prévoit une liste de personnes assimilées à des personnes vivant au foyer qui comprend les titulaires du bail, les personnes figurant sur l’avis d’imposition des titulaires du bail, le concubin notoire ou le partenaire de PACS du titulaire du bail ainsi que les personnes considérées comme à charge.
