Madame F. est hébergée avec ses deux enfants en CHRS liée par un contrat de séjour qui arrive à son terme le 9 juin 2008.

Elle saisi la commission de médiation le 4 février 2008 afin que celle-ci la reconnaisse comme prioritaire pour l'attribution en urgence d'un logement comme le prévoit le « DALO » institué par la loi du 5 mars 2007.

Le 3 mars 2008, la commission lui notifie un avis défavorable : sa demande est certes prioritaire, mais n’est pas urgente. La commission invite madame F. à réitérer sa demande à la fin de sa prise en charge en CHRS. Madame F. et l'association Droit au Logement (DAL) déposent un recours en excès de pouvoir pour annuler cette décision. Parallèlement, elles saisissent le juge des référés afin qu’il suspende la décision en urgence et qu'il ordonne à la commission de se prononcer à nouveau sur la situation de Madame F.

C'est la première fois, depuis le 1^er janvier 2008, qu'un juge statue sur la décision d'une commission de médiation.

-                     Le juge des référés retient un doute sérieux sur la légalité de la décision. Madame F. est hébergée dans un centre d’hébergement depuis plus de six mois : elle remplit les critères pour se voir reconnaître prioritaire. La commission de médiation ajoute une condition qui n'est pas prévue par les textes : l’arrivée à terme du contrat d’hébergement. Il appartient à la commission de s’informer de la pertinence de prolonger un hébergement qui doit être justifié par un processus de réinsertion sociale.

-                     S'agissant de l'urgence, celle-ci est constituée du fait de la situation de madame F et de ses deux enfants : aucun autre hébergement ne lui a été proposé et le CHRS n’était nullement tenu de la faire. Les CHRS ne sont pas des structures d’hébergement d’urgence au sens de l’article 4 de la loi DALO : l’obligation de maintien ne peut pas être invoquée. Madame F. peut donc se retrouver à la rue le 9 juin. Sa situation est constitutive d'une urgence qui justifie que la décision de la commission de médiation soit suspendue et qu’elle se prononce une nouvelle fois dans le délai d’un mois.
